1. Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of the Hangar mobile application, websites, live tracking pages, widgets, and related services (collectively, the “Service”) operated by Fly Hangar, LLC (“Hangar,” “we,” “us,” or “our”). By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Description of Service

Hangar is a social flight tracking and aviation community platform. The Service may allow users to automatically or manually track flights, share flight posts, upload photos and videos, view maps and airport information, create groups and events, send messages, receive safety notifications, access subscriptions, and interact with aviation-related content, sponsors, advertisers, and partner offers.

The Service is provided for informational, social, community, entertainment, analytics, and convenience purposes only. Hangar is not an avionics product, navigation product, air traffic service, emergency service, dispatch service, maintenance service, or regulatory compliance system.

3. Eligibility and Accounts

You must be at least 13 years old to use the Service. If you are under 18, you represent that you have permission from your parent or guardian. To use certain features, you must create an account. You agree to provide accurate information, keep your credentials secure, maintain current contact information, accept responsibility for activity under your account, and notify us promptly of unauthorized use.

You may not impersonate another person, create an account for someone else without permission, claim aircraft, airports, credentials, ratings, or affiliations you do not have, or use another user's account.

4. Subscriptions, Purchases, and Paid Features

Certain features may require a paid subscription or purchase, such as Hangar Pro. Unless otherwise stated, in-app subscriptions are billed through Apple's App Store and may be managed through your Apple account settings. Subscriptions may automatically renew unless cancelled before the renewal date. Refunds are handled according to Apple's policies and applicable law.

Deleting your Hangar account or uninstalling the app does not automatically cancel an active App Store subscription. You are responsible for managing cancellation, renewal, and restore settings through the applicable app store account.

5. Flight Tracking, Location, and Safety Notifications

Hangar uses location, motion, barometric, network, ADS-B, and aviation data to provide automatic flight detection, live tracking, safety contact notifications, flight uploads, replays, maps, stats, and debugging. You acknowledge and agree that:

  • Automatic tracking may require “Always Allow” location, motion, notification, background activity, Live Activity, and local network permissions
  • Hangar may collect and process live and historical location, flight, sensor, device, ADS-B, and debug data to operate, troubleshoot, secure, and improve tracking accuracy
  • Hangar may use silent push notifications, geofences, significant location changes, or background tasks to maintain or recover tracking sessions when supported by your settings and operating system
  • Live flight position may be visible to followers, safety contacts, public viewers, group members, or anyone with a shared tracking link, depending on your settings and how links are shared
  • Safety contacts may receive text messages or links with your name, username, flight status, airports, and live tracking information
  • GPS, ADS-B, airport, map, weather, telemetry, estimated arrival, and flight detection data may be delayed, incomplete, inaccurate, unavailable, or incorrectly matched
  • You are solely responsible for safe aircraft operation, passenger communications, compliance with aviation regulations, and deciding whether it is appropriate to share location, aircraft, route, media, or other flight information

6. No Navigation, Emergency, or Regulatory Use

Do not rely on Hangar for navigation, collision avoidance, air traffic separation, weather avoidance, emergency response, flight planning, dispatch, maintenance, logbook compliance, regulatory reporting, aircraft control, or any safety-critical use. Always use approved aviation tools, official sources, training, judgment, and applicable procedures. Hangar is not responsible for decisions made based on information shown in the Service.

7. User Content

“User Content” means content you submit, upload, post, transmit, or make available through the Service, including profile information, photos, videos, flight data, tracks, captions, comments, messages, reviews, airport or place submissions, event content, group content, reports, and feedback.

You retain ownership of your User Content. By submitting User Content, you grant Hangar a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, display, perform, publish, distribute, modify, adapt, create derivative works from, analyze, and otherwise use your User Content to operate, improve, secure, promote, and provide the Service.

When you make an account, profile, flight, post, photo, video, review, group, event, place, or other content public, or when you submit content to public areas of the Service, you also grant Hangar a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use your public User Content, name, username, profile image, likeness, voice, flight information, and associated metadata in Hangar marketing, social media, websites, App Store materials, press, advertising, sponsored content, investor materials, and other promotional materials, without compensation to you. This license continues for materials created before you delete the content or ask us to stop future promotional use.

We do not claim ownership of your private messages, private-account media, or safety contact information. We will not intentionally use private messages, private-account media, or safety contact information in public marketing materials without your permission, but they may still be processed to operate, moderate, secure, and improve the Service.

8. Your Responsibilities for Content

You represent and warrant that you own or have all rights needed to share your User Content and grant the licenses in these Terms. You are responsible for ensuring your content does not violate law, privacy rights, publicity rights, intellectual property rights, aviation security obligations, contractual restrictions, airport rules, or the rights of passengers, aircraft owners, photographers, videographers, event organizers, or other third parties.

You may not post content that is illegal, defamatory, harassing, hateful, sexually explicit, exploitative, threatening, invasive of privacy, misleading, spammy, malicious, unsafe, or otherwise objectionable. You may not post another person's private information, sensitive location information, private aircraft information, or media of another person without any permission required by law or by the context.

9. Community Safety and Moderation

Hangar includes user-generated content and community features. We may remove content, restrict visibility, block distribution, suspend accounts, terminate accounts, preserve reported content, or take other action if we believe content or conduct violates these Terms, creates risk, infringes rights, or harms the Service or community. We may provide reporting, blocking, moderation, and admin tools, but we do not guarantee that all objectionable content will be removed or reviewed immediately.

10. Advertising, Sponsorships, and Partner Offers

Hangar may display, sell, manage, personalize, measure, or facilitate ads, sponsorships, promoted content, advertiser portals, aviation business listings, event promotions, partner offers, and similar commercial features. We may use information described in our Privacy Policy, including account information, public content, app usage, purchase status, aviation interests, and approximate or airport-level location, to deliver and measure these features.

We do not authorize advertisers to use safety contact information, private messages, or contact imports to target ads. If we introduce practices that require additional consent, App Tracking Transparency permission, or opt-out rights under applicable law, we will provide the required notice and choice. Advertiser, sponsor, and partner content may link to third-party services, and Hangar is not responsible for third-party products, services, claims, or data practices.

11. Acceptable Use

You agree not to:

  • Use the Service for any unlawful, deceptive, harmful, harassing, abusive, or unauthorized purpose
  • Interfere with, disrupt, reverse engineer, scrape, crawl, index, overload, or compromise the Service or its systems
  • Access, collect, or use another user's information except as allowed by the Service and these Terms
  • Upload malware, exploit code, spam, unauthorized advertising, or content designed to manipulate engagement
  • Bypass privacy settings, security controls, rate limits, subscription gates, or access restrictions
  • Misrepresent flight activity, identity, aircraft ownership, credentials, affiliation, endorsements, sponsorships, or commercial relationships
  • Use Hangar to stalk, track, surveil, dox, threaten, or harm another person
  • Use the Service to develop a competing product or train models in a way that violates these Terms or applicable law

12. Intellectual Property

The Service, including its software, design, trademarks, logos, trade dress, text, graphics, data structures, and non-user content, is owned by Hangar or our licensors and is protected by intellectual property laws. Except for rights expressly granted in these Terms, you may not copy, modify, distribute, sell, lease, create derivative works from, or exploit any part of the Service without our written permission.

If you submit suggestions, ideas, bug reports, feature requests, or feedback, you grant Hangar the right to use them without restriction or compensation.

13. Third-Party Services and Data

The Service integrates with third-party services and data sources, including Firebase and Google Cloud, Apple, Google, Facebook SDKs, Mapbox, ArcGIS, FlightAware/AeroAPI, ADS-B data providers, Mux, RevenueCat, Superwall, Mixpanel, Twilio or other messaging providers, app stores, and other providers. Third-party services may be subject to separate terms and privacy policies. Hangar is not responsible for third-party availability, accuracy, security, policies, content, or changes.

Aviation, airport, weather, aircraft, map, ADS-B, and third-party data may be incomplete, delayed, inaccurate, or unavailable. Do not use it as your sole source of truth for operational decisions.

14. Privacy

Our Privacy Policy explains how we collect, use, share, and retain information. By using the Service, you agree that Hangar may process information as described in the Privacy Policy, including location, flight, sensor, media, analytics, diagnostics, subscription, and public content information.

15. Termination

You may stop using the Service at any time and may delete your account through the app settings. We may suspend or terminate your account or access to the Service at any time if we believe you violated these Terms, created risk, infringed rights, abused the Service, or if we discontinue the Service. After termination, provisions that by their nature should survive will survive, including content licenses, disclaimers, limitations of liability, indemnity, and dispute provisions.

16. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, HANGAR DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND RELIABILITY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, ACCURATE, OR AVAILABLE WHEN NEEDED.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLY HANGAR, LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, PARTNERS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, FLIGHT INFORMATION, BUSINESS OPPORTUNITIES, OR PERSONAL OR PROPERTY DAMAGES ARISING FROM OR RELATED TO THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID TO HANGAR FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR $100.

18. Indemnity

You agree to defend, indemnify, and hold harmless Fly Hangar, LLC and its owners, officers, employees, contractors, partners, and service providers from any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising from or related to your use of the Service, your User Content, your violation of these Terms, your violation of law, or your violation of another person's rights.

19. Changes to the Service or Terms

We may modify, suspend, or discontinue any part of the Service at any time. We may update these Terms from time to time by posting the updated Terms and changing the “Last Updated” date. If changes are material, we may provide additional notice. Your continued use of the Service after updated Terms become effective means you accept the updated Terms.

20. Governing Law and Venue

These Terms are governed by the laws of the State of Washington, without regard to conflict of law rules. You and Hangar agree that disputes arising from or relating to these Terms or the Service will be resolved in the state or federal courts located in Washington, except where applicable law requires otherwise.
